देश की राजधानी दिल्ली में ‘सेवाओं’ (Services) के नियंत्रण को लेकर चल रही लंबे समय से राजनीतिक और कानूनी जंग में सुप्रीम कोर्ट ने आज बड़ा फैसला सुनाया है। कोर्ट ने दिल्ली सरकार को सेवाओं पर फिर से नियंत्रण सौंप दिया है, जिससे प्रशासनिक नियुक्तियों और ट्रांसफर-पोस्टिंग के अधिकार उपराज्यपाल (LG) से हटाकर निर्वाचित सरकार को दे दिए गए हैं।
क्या है मामला?
दिल्ली सरकार और केंद्र के बीच पिछले कई सालों से यह विवाद चल रहा था कि ‘सेवाओं’ यानी अफसरों की नियुक्ति, ट्रांसफर और प्रशासनिक नियंत्रण किसके पास होगा।
2015 में केंद्र ने एक नोटिफिकेशन के जरिए यह अधिकार उपराज्यपाल को दे दिए थे, जिसके बाद आम आदमी पार्टी सरकार लगातार इसका विरोध कर रही थी।
2023 में सुप्रीम कोर्ट ने दिल्ली सरकार के पक्ष में फैसला दिया था, लेकिन केंद्र ने तुरंत अध्यादेश लाकर फैसला बदल दिया।
अब, 2025 में सुप्रीम कोर्ट की 5 जजों की संवैधानिक पीठ ने केंद्र के अध्यादेश को असंवैधानिक करार देते हुए फिर से दिल्ली सरकार को यह अधिकार दे दिया है।
कोर्ट की टिप्पणी
मुख्य न्यायाधीश (CJI) ने कहा,
“लोकतांत्रिक ढांचे में निर्वाचित सरकार को अपने कर्मचारियों और प्रशासन पर नियंत्रण होना चाहिए, वरना जनता की जवाबदेही खत्म हो जाएगी।”
राजनीतिक प्रतिक्रियाएं
अरविंद केजरीवाल (दिल्ली CM) ने कहा, “यह दिल्ली की जनता की जीत है, अब अफसर जनता के लिए काम करेंगे, न कि किसी के दबाव में।”
BJP ने कहा कि यह फैसला प्रशासनिक दक्षता और भ्रष्टाचार के मुद्दों पर असर डाल सकता है, इसलिए सतर्क रहना होगा।
आगे क्या?
इस फैसले के बाद दिल्ली सरकार को सभी सेवाओं के ट्रांसफर, पोस्टिंग और नियुक्ति के आदेश जारी करने का अधिकार मिल जाएगा। हालांकि, पुलिस, पब्लिक ऑर्डर और लैंड मामलों में अब भी केंद्र का नियंत्रण रहेगा।

In a landmark verdict, the Supreme Court has handed back control over ‘services’ to the Delhi government, ending a prolonged power tussle between the Centre and the elected administration. This means that the Delhi government will now have the authority over transfers, postings, and appointments of its officers, which were earlier vested with the Lieutenant Governor (LG).
Background
The dispute between the Delhi government and the Centre dates back to 2015 when the Centre transferred control of services to the LG through a notification.
In 2023, the Supreme Court ruled in favour of the Delhi government, but the Centre overturned it via an ordinance.
In 2025, a five-judge constitutional bench struck down the ordinance, calling it unconstitutional.
Court’s Observation
Chief Justice remarked:
“In a democracy, the elected government must have control over its staff and administration; otherwise, public accountability is lost.”
Political Reactions
CM Arvind Kejriwal: “This is a victory for the people of Delhi. Officers will now work for the public, not under political pressure.”
BJP: Warned that the decision could affect efficiency and corruption control, urging caution.
